The Court of Justice of Holland has ruled in favor of Viña Errázuriz S.A., in a lawsuit against the use by a third party of the brand name “Errázuriz”. The ruling gives the use of the trademark “Errázuriz” exclusively to Viña Errázuriz S.A.


The company launched the lawsuit against Viñedos Errázuriz Ovalle S.A., a rival Chilean company, for the use of the brand name “Errázuriz” on its labels. The ruling requires that all the wines with Errazuriz Ovalle labels must be taken immediately off the retailers’ shelves in Holland as they are not allowed to be sold in Dutch territory.


The Supreme court in Chile recently found in favour of Viña Errázuriz S.A as well over the brand name battle.

Patrick McGrath MW, managing director of Viña Errázuriz’s UK agents, Hatch Mansfield said: “Eduardo Chadwick’s family founded Vina Errazuriz in 1870 and it is galling for them to see others attempting to use their good name. We will take every step necessary to ensure that no such confusion will ever take place in the UK.”
