The PepsiCo subsidiary PepsiCo Investment (China) Ltd is being sued by Sichuan Yunlu , the joint venture partner it is trying to sever ties with.
PepsiCo Investment is being accused of violating commercial secrets, the state press said this week, by trying to steal the mobile phone records of Sichuan Yunlu manager Hu Fengxian.
PepsiCo has been trying to dissolve its joint venture with Sichuan Yunlu for over a year, accusing its Chinese partner of trying to restructure the company and using funds without consent.
The lawsuit comes as PepsiCo has been trying for more than a year to dissolve its tie-up with Sichuan Yunlu after accusing manager Hu Fengxian of restructuring the company and using company funds without consent of the joint venture partner.
Pepsi’s case was dismissed from an independent arbitrator in Stockholm in August on procedural grounds. Since then Sichuan Yunlu has taken Pepsi to a Chinese panel seeking compensation for breach of contract.
