The Coca-Cola Co has reportedly filed a lawsuit against PepsiCo in an Australian court, claiming its rival has copied the "curvy contours" of the classic Coca-Cola bottle.

The Atlanta-based firm, which claims to account for around 70% of Australia's soft-drink market, has alleged that the Pepsi glass bottle is "substantially identical with or deceptively similar to" Coca-Cola's contour bottle, a registered trademark, according to The Daily Telegraph in Australia. Coca-Cola will need to prove PepsiCo has been using the bottle shape to identify the product as Pepsi and that it is similar enough to Coca-Cola's to cause confusion in order to win the case, the publication wrote.

PepsiCo has been selling the contested bottles in Australia since 2007. The company said it would not comment on pending litigation.

A spokesperson for Coca-Cola told just-drinks: "We have declined to comment on the issue as this is pending litigation."
