UK: Scottish minimum pricing to be delayed until legal battle ends

The Scottish government's plans for alcohol minimum pricing are facing a lengthy delay after ministers said the measure will not be implemented until legal challenges have concluded.
The much-touted idea for a GBP0.50 (US$0.80) a unit minimum was due to come into force next April. But opposition to the proposal has been widespread of late.
The Scotch Whisky Association launched a two-pronged legal challenge in July, arguing that minimum pricing would breach European Union (EU) trade rules and "artificially distort trade in the alcoholic drinks market, contrary to EU law".
EU countries have also raised concerns with the European Commission, including Bulgaria, Italy, France, Spain and Portugal. And, in an initial response, the EU Commission admitted it has a "problem with the compatibility of minimum pricing plans under community law".
In a statement today, the Scottish government said it is "disappointed that a legal challenge could cause a delay to such a vital policy".
"Ministers have given an undertaking not to implement minimum unit pricing for alcohol until the judicial process has been completed," the statement added.
Meanwhile, Gavin Partington of the Wine & Spirit Trade Association told just-drinks last month the issue could go all the way to the highest court possible - the European Court of Justice.
