E&J Gallo has filed a lawsuit against Lion Nathan for lodging applications to use a trademark already in use by the US wine company.

Speaking to just drinks today (5 November), a spokesperson for Lion confirmed that the company is being sued by Gallo after the Trans-Tasman drinks company attempted to register the 'Barefoot' trademark in Australia.

The spokesperson said: "As far as I am aware, Gallo have a Barefoot trademark, but not in Australia.

"The issue will be dealt with early next year in January or February."

According to a filing at the federal court last week, family-run wine company Gallo reportedly registered the Barefoot trademark in Australia over eight years ago, but this year Lion has been trying to apply for a trademark of the same name for both beers and wines.
