Bacardi has vowed to continue its battle over the Havana Club trademark in Spain, despite the country's Supreme Court's confirmation of its recent ruling in favour of Pernod Ricard.
Last month, the Spanish Supreme Court ruled that ownership of the Havana Club trademark in the country belongs to Pernod's Havana Club Holdings (HCH) joint-venture with Cubaexport. Bacardi, which claimed at the time that the ruling fell in Pernod's favour solely on a legal technicality involving the statute of limitations, subsequently pushed for clarification of the ruling.
Yesterday (14 March), Pernod announced that the Supreme Court has restated that the trademark belongs to HCH, and that “Bacardi has no right to claim ownership of the trademark in Spain”.
Earlier today, Bacardi countered that it will “continue to pursue all available legal options to protect its legitimate ownership and trademark rights to the Havana Club brand in Spain.
“Bacardi will continue to defend its fundamental rights against expropriation having purchased the trademark rights in Spain from the original legal owners, creators and proprietors of the brand,” the company said.
When contacted for further details on Bacardi's plans, a spokesperson for the company told just-drinks: “We have options in this case and are studying them now.”
