Although the industry is in favor of expanded curbside recycling programs, the trend has been towards more states adopting deposit laws for bottled water.

  • Proponents of deposit laws argue that the only way to solve the problem of plastic bottles accumulating in landfills is to force people to pay a deposit at point of purchase so that they are incentivized to return the container to the retailer or redemption center to get their money back.
  • Instead, the IBWA and its member companies are in favor of curbside recycling, which are in only about 50% of communities at present - with a 25% participation rate. This compared to the estimated 70%-plus recycling rates in states with deposit laws.
  • Nonetheless, the IBWA and others argue that forced deposit systems are not as effective as once promised and that they apply only to beverage containers (unlike curbside recycling which captures a broader array of packaging). Deposit law proponents turn this logic on its head, arguing that if plastic bottles of soda are subject to a deposit, why not a plastic bottle of water?
  • Trade groups like the National Association of Convenience Stores oppose deposit systems because retailers have to incur an extra expense to handle and store empties.
  • In 2009, three states extended deposit laws to include bottled water: New York, Connecticut and Oregon. This brought the tally of states requiring a deposit on bottled water to nine, including California, Iowa, Massachusetts, Maine, Michigan and Hawaii. A 5-cent deposit, such as adopted in New York, increases the retail ring of a typical 24-bottle case from $4.00 to $5.20. According to food industry groups, such deposit laws encourage the buying of water in neighboring states and also encourages people to redeem bottles purchased in bordering states in the deposit-law state.
  • In order to curtail the momentum towards deposit laws, NWNA announced it would be part of an industry-wide commitment to achieve a 60% PET recycling rate by 2018. Separately, Coca-Cola Company pledged to recycle 50% of all plastic and aluminum containers it sells by 2015.
  • The National Association for PET Container Resources (NAPCOR), a trade group, claims that PET water recycling rates jumped from 32% to 39% from 2010 to 2011.
  • The latest buzz-phrase is "extended producer responsibility" (EPR) in which producers pay a fee to fund curbside and away-from-home recycling programs and then recoup some or all of those costs by incorporating them into the product price. NWNA has come out in favor of EPR, which has been implemented for other difficult-to-dispose consumer goods like electronics and tires. Proponents of EPR claim that more than $11 billion worth of packaging finds its way into landfills each year instead of being recycled.
